How Foreclosure Auctions Work in Virginia
Virginia uses a non-judicial foreclosure process, which means lenders can foreclose on a property without going to court — as long as the deed of trust contains a power of sale clause. Most Virginia deeds of trust include this clause, making non-judicial foreclosure the standard path when a borrower defaults.
The Role of the Trustee
Instead of a judge, the process is administered by a trustee — typically an attorney or title company named in the deed of trust. The trustee is responsible for sending required notices to the borrower, advertising the sale in a local newspaper, and conducting the auction. Virginia law requires the trustee to advertise the sale at least once a week for two consecutive weeks before the auction date.
Deposits and Bidding
Most Virginia foreclosure auctions require a cash deposit at the time of sale — often 10% of the bid or a set dollar amount specified in the trustee's advertisement. The winning bidder must come prepared with certified funds or a cashier's check. If you cannot close, you forfeit your deposit. Full payment is typically due within 15 to 30 days of the sale.
Due Diligence Before You Bid
Properties at foreclosure auction are sold as-is. You typically cannot inspect the interior before bidding, and there is no warranty of any kind. Before bidding, you should research the property's title for any liens that would survive the foreclosure (IRS tax liens and certain mechanics' liens can sometimes survive), verify the property's condition from the exterior, check tax records, and review the trustee's advertisement carefully for any encumbrances.
Cancellations and Postponements
Foreclosure sales in Virginia are frequently postponed or cancelled at the last minute — sometimes because the borrower reinstates the loan, files for bankruptcy, agrees to a short sale, or reaches another resolution with the lender. Closing and Title
After a successful auction, the trustee issues a trustee's deed to the winning bidder. This deed conveys whatever interest the foreclosing lender held — it does not provide the same title warranties as a normal real estate transaction.
